2.2 Data processing of contact details

When we enter into and conduct business relationships with suppliers, customers and partners, we process and store personal data of their employees and auxiliary persons for contract initiation and execution, planning, accounting purposes and other purposes related to the contract. Depending on the area of activity, we may also be required to examine the company in question and its employees in more detail, e.g. by conducting a security check. In this case, we may collect and process additional information, including from third parties. We may also process personal data to improve our customer orientation, customer satisfaction and customer retention (customer/supplier relationship management).

2.3 Data processing during job applications and the application process

In the case of job applications, the data controller - which is usually the company that has advertised the position in question or to which you are applying - processes applicants' personal data for the purpose of handling the application process. Processing may also take place electronically. This is particularly the case if an applicant sends corresponding application documents to the controller by electronic means, for example by e-mail. We process personal data that you provide to us as part of your application for the purpose of handling the respective application procedure, insofar as this is necessary to review your application dossier in connection with the vacant position and, if successful, to prepare the employment relationship.

Depending on the purpose, our processing is based on different legal bases. In particular, we may process personal data if the processing:

(a) is necessary for the performance of a contract with you;
(b) is necessary for the performance of legitimate interests;
(c) is based on effective consent that has not been revoked;
(d) is necessary for compliance with legal obligations.
We consider legitimate interests to include, for example:
(a) our customer care and maintenance of our business relationships (e.g., maintaining contacts, communication with our business partners);
(b) advertising and marketing activities;
(c) the possibility to get to know the users of our website and our online services better;
(d) the improvement and further development of our products and services (e.g. IT security in connection with the use of our website; improvement of our range of online services);
(e) internal group administration.

As a rule, there is no obligation to disclose personal data to us. However, we will have to collect and process those personal data that are necessary for the establishment and processing of a contractual relationship with you or a company for which you work. Technically unavoidable is also the processing of log data and certain other data when using websites. Also, when communicating with us, we must process at least those personal data that you provide to us or that we provide to you.

In connection with the processing of your personal data, you have the following rights under the law applicable to you:
Right to information:
You have the right to request information about your personal data stored by us free of charge at any time. In individual cases, the right to information may be restricted or excluded, in particular if there are doubts about the identity or if this is necessary to protect other persons.
Right to rectification:
You have the right to have incorrect or incomplete personal data corrected or completed and to be informed about the correction.
Right to erasure:
You have the right to request the deletion of your personal data if the personal data is no longer necessary for the purposes pursued, you have revoked your consent or objected to the processing, or the personal data is being processed unlawfully.

Right to restrict processing:
Under certain circumstances, you have the right to request that the processing of your personal data be restricted.
Right to data transfer:
You have the right to receive from us the personal data that you have provided to us in a structured, common and machine-readable format, provided that the specific data processing is based on your consent or is necessary for the performance of the contract and the processing is carried out with the help of automated procedures.
Right of withdrawal:
You have the right to revoke your previously given consent to specific processing at any time. The revocation applies only for the future; processing activities in the past that were carried out based on your consent are not affected by your revocation and remain lawful.
Right of objection:
You may object to data processing at any time and generally freely revoke consent to data processing. A right of objection exists in particular against data processing in connection with direct advertising (e.g. against newsletters).

To exercise these rights, please contact the data protection officer (e-mail).
Right of complaint:
You are free to complain to the competent supervisory authority if you believe that your rights have been violated by a particular data processing operation. In Switzerland, please contact the Federal Data Protection and Information Commissioner (FDPIC).

Your personal data will not be shared with third parties outside the company. Click & Power reserves the right to share your personal data with other companies to the extent necessary to provide services to Click & Power. These companies are obligated to Click & Power (e.g. by contract) to comply with applicable laws and our privacy policy when processing your personal data. Furthermore, Click & Power will disclose your data to other third parties only if and to the extent required or permitted by applicable law, court order or government regulation.

Click & Power produces, trades and distributes energy and other products in Switzerland, Europe and the USA. We may therefore transfer your data to a Click & Power recipient outside your country of residence and possibly to a country without an adequate level of data protection. If we transfer personal data to such a country, we are obliged to ensure the protection of your personal data in an appropriate manner, e.g. by data transfer agreements with the recipients, for example the so-called standard contractual clauses, which you can access here.

Your personal data will be retained by us in accordance with the applicable data protection laws only for as long as is necessary for the stated purpose. Technical data (e.g. log files), cookies or information in connection with social plugins will be deleted after 12 months at the latest, provided that we are responsible for the corresponding processing.
If an application process that has been carried out is successful, the data transmitted in this context may continue to be stored for the purpose of processing the employment relationship in compliance with the statutory provisions, insofar as it is necessary for the implementation of the employment relationship. If no employment comes about, the application documents are automatically deleted six months after notification of the rejection decision, provided that no other legitimate interests of the data controller oppose deletion. You can find out more about cookies here.

We take appropriate technical and organizational measures to ensure the protection of your personal data. Only persons have access to your personal data if and insofar as this is necessary for the purposes described here and the performance of the respective activity (e.g. HR officers; IT system officers). All persons are subject to the obligation to process the personal data confidentially and exclusively in accordance with the applicable data protection rules and regulations. Data transmissions to us take place over an open network that is accessible to anyone and transcends borders, and are transmitted unencrypted. However, Click & Power has taken security measures to protect the data from unauthorized actions and to guarantee the authenticity of the website, the integrity of the data and the confidentiality of the data transmitted via the group's internal network (intranet). Nevertheless, it cannot be ruled out that data sent in this way may be lost, may be viewed by third parties and, consequently, that contact with us may be traced. Consequently, this may lead to your data being disclosed or its content being changed, thus also in countries without an adequate level of data protection. In addition, personal data may also be transferred via or to countries without an adequate level of data protection. Click & Power accepts no liability for direct or indirect damage resulting from such data transfers.

Privacy policy

The following data protection declaration may be revised at certain intervals at Click & Power's own discretion and without prior notice. The version of the data protection declaration valid at the time of processing your personal data, which can be accessed via the following link, shall apply.
